1. Who we are and what this is
Liminal is the service at getliminal.app, operated by the people named on that site ("Liminal", "we", "us"). It lets a photographer or studio keep photographs, arrange exhibitions and publish selections to other people through share links, augmented-reality shows and public websites. By creating an account or accepting these terms on behalf of one, you agree to them. If you do not agree, do not use the service.
2. Your account
Anyone may open an account with an email address they control, and members can be invited into an existing account. Before an account can be used, one of its admins accepts these terms. They do so for the whole account, including every member invited into it, and remain responsible for everything published under it. Keep the email address you sign in with under your control: anyone who can read its mail can sign in as you.
3. What you may publish
You may upload and publish only material that you created, that you own, or that you hold the rights to publish here — including the written permission of any recognisable person in a photograph where the law where it was taken or where it is shown requires one. You keep every right to your material. You grant Liminal only what it needs to run the service: to store your files, to make resized copies of them, and to show them to the people you choose to share them with, for as long as your account keeps them.
4. Zero tolerance
The following are forbidden on Liminal, in any form, on any surface, published or not:
- pornography, sexually explicit material, and any sexual content involving a minor or a person who looks like one;
- intimate images of a person shared without that person's consent;
- content that discriminates against, degrades or incites hatred or violence towards people on the grounds of race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability, age or any other condition;
- content that harasses, shames, humiliates, threatens or exposes a person, or that publishes private information about them without their consent;
- content that depicts, promotes or celebrates violence, cruelty, abuse, exploitation or any violation of human rights;
- material that infringes someone else's copyright, trademark or other rights, or that you do not have the right to publish;
- anything that is illegal where you are, where we are, or where it is shown.
This list describes the intent; it is not exhaustive. We decide whether something falls under it.
5. Enforcement
Tolerance is zero. An account found to hold or publish any of the material above — whether we detect it or someone reports it — is closed at once, without warning, without a period of notice and without a review or appeal. Its content is removed and its share links, shows and websites stop working. We may keep a copy of the offending material and the account's records for as long as the law requires, and we may hand them to the authorities. There is no compensation for an account closed under this section.
6. Copyright and other claims
If you believe material on Liminal infringes your rights, write to [email protected] with the address where it appears, what you own and how to reach you. We remove material we reasonably believe to infringe, and we close the account that published it under section 5. Knowingly false claims are themselves a breach of these terms.
7. Your responsibility
You alone are responsible, legally and otherwise, for everything uploaded to or published from your account, by you or by any member of it. Liminal and the people who operate it are hosts: we do not review material before it is published, we do not endorse it, and we accept no responsibility for it. If a claim, demand, fine or legal action is brought against Liminal or its operators because of material in your account or because of your use of the service, you will defend them, answer for it and cover every cost that follows, including legal fees.
8. Reporting
Anyone can report material that breaks these terms by writing to [email protected]. Say where it is and what is wrong with it. We read every report; we do not promise a reply.
9. The service
Liminal is provided as it is and as it is available. We work to keep it up and to keep your files safe, but we do not promise that it will always be reachable, error-free or unchanged, and we may change, suspend or withdraw any part of it. Keep your own copies of your photographs. To the fullest extent the law allows, Liminal and its operators are not liable for any loss or damage arising from the service or from material published on it, and in any case our liability to you is limited to what you have paid us for the service in the twelve months before the claim, if anything.
10. Closing your account
You can delete your projects and ask us to close your account at any time by writing to [email protected]. Closure under section 5 is at our discretion and is final.
11. Changes to these terms
We may revise these terms. The current version and its date are always at getliminal.app/terms. Continuing to use the service after a revision means you accept it.
12. Law and disputes
These terms are governed by the laws of Mexico, and any dispute about them or about the service is submitted to the competent courts of Mexico, waiving any other jurisdiction. If a part of these terms cannot be enforced, the rest stands.
